Ivanhoe College Employer's Liability Insurance Certificate.

 

Following the introduction of the Jackson reforms during 2013, the way in which Personal Injury (PI), i.e. Public Liability and Employers’ Liability claims are now handled has changed significantly. The reforms have been introduced, amongst other things, as a way to speed up the handling of PI claims and to control legal costs arising from successful claims of this type.

Personal Injury claims occurring on or after 31st July 2013, with a value between £1,000-£25,000, should be received and handled via a new electronic claims portal.

Personal Injury claims should be acknowledged within 24 hours of receipt into the Portal. Public Liability claims thereafter have to be investigated within an 8 week period and Employers’ Liability claims within a 6 week period, and the liability decision conveyed to the claimant’s representatives.

If these claims are handled within the Portal the legal costs of the claims will be significantly reduced.

  • for successful claims between £1k- £10k, the claimant’s legal costs will be capped at £900
  • for successful claims between £10k and £25k, the claimant’s legal costs will be capped at £1,600

Claims with a value between £1k-£25k which fall outside of the Portal, are subject to an increased fixed scale of costs.

It is important therefore that as many claims as possible remain within the Portal process in order to keep claimants’ legal costs as low as possible.
